Generally no. In Belgium, once the seller accepts the buyer’s offer the sale is legally formed, and there is no automatic cooling-off period. A buyer can only step back through a suspensive condition that fails or a specific clause agreed in writing (Civil Code, article 1583).
Many international buyers assume they have a few days to change their mind, as in some other countries. In Belgium that assumption is wrong and can be costly. The sale is formed as soon as the parties agree on the property and the price, which happens the moment an offer is accepted, well before the notary’s deed (Civil Code, article 1583).
There is no general legal cooling-off period for a private home purchase in Belgium, unlike the statutory reflection period that exists in France. So a buyer who simply gets cold feet after an accepted offer or a signed compromis is, in principle, bound to complete, and can be liable for damages, commonly framed around the deposit of about 10%, if they walk away without a valid reason.
The lawful exits are specific. A suspensive condition that fails, most often the refusal of a mortgage despite a genuine application, unwinds the sale without penalty (immomakelaarvergelijker.be, 2026). The parties can also agree a bespoke withdrawal clause, or a mutual cancellation, but only if it is written and accepted by both sides.
