Yes. A consumer can withdraw within 14 calendar days of signing, and can end the mandate later by giving the notice set by law. Any early-exit indemnity on a fixed term is capped at 50% of the commission in the first three months and 25% afterwards (IPI, 2024).
A sale mandate is a contract, but Belgian consumer law gives sellers several clear ways out, so you are never permanently locked in.
The first is the cooling-off right. Under the Royal Decree of 28 September 2023, in force since 1 February 2024, a consumer who signs a mandate has 14 calendar days to withdraw, with no reason and no cost (IPI, 2024). This applies whether the contract was signed at the office or elsewhere.
After that window, ending the mandate depends on its form. An open-ended mandate can be terminated with a maximum of two months’ notice. A fixed-term mandate that renews tacitly can be stopped with a maximum of one month’s notice when the initial term is three months or less, and two months when it is longer (IPI, 2024). At the natural end of a fixed term, you simply let it lapse by giving the required notice.
Ending a fixed term early, without cause, while the property is still unsold, can trigger an indemnity, but the law caps it: at most 50% of the agreed commission in the first three months, and at most 25% after that (IPI, 2024).
